1. GENERAL UNDERSTANDING

 1a. Generations Getaways (“GG”) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). GG is not responsible for acts or omissions of the Suppliers or their failure to provide services, future trip credits, or adhere to their own schedules.

1b. GG assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under GG’s control; or (4) accidents, riots, strikes, pandemics/epidemics, acts of God, forces of nature, or any other legitimate condition beyond GG's control. You hereby release GG from all claims arising out of any problem covered in this paragraph.

1c. You acknowledge and understand that Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. (GG strongly recommends that you purchase trip cancellation insurance.) By accepting this itinerary or invoice, and/or by submitting a payment on a reservation, you hereby consent to those terms and conditions.

1d. GG has no special knowledge regarding the financial condition of the Suppliers, and shall not be liable for any recommendation to accept or decline Supplier future trip credits. Further, GG does not have any special knowledge regarding unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, GG recommends reviewing the Travel Advisories Section of the U.S. State Department website (travel.state.gov). For medical information, GG recommends contacting the Centers for Disease Control at (877) FYI-TRIP or visiting their website (cdc.gov/travel). You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release GG from all claims arising out of any problem covered in this paragraph, and to submit all other claims against us within 30 days after the return of your trip. You agree that the courts in Kent County, Rhode Island will be the exclusive jurisdiction for all claims brought by you or GG, and you hereby submit to the personal jurisdiction of those courts.

 

  1. SUPPLEMENTAL INCREASES AND PENALTIES

 2a. Travel arrangements are always subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to, and authorize your credit or debit card to be charged for, any such price increases.

 

  1. FORCE MAJEURE

 3a. The definition of “Force Majeure” is “an event or effect that cannot be reasonably anticipated or controlled.” In relation to GG, this means any circumstances beyond the reasonable control of GG. Including, but not limited to, acts of God, explosion, flood, tempest, forceful wind, fire, accident, war or threat of war - declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, pandemic, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).

3b. GG shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.

3c. If GG, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by GG, and/or any of its travel suppliers, to you as a result of the non-performance of any obligations hereunder shall remain at their sole and absolute discretion, although GG shall use all reasonable efforts to reimburse you where possible. However, GG shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to GG of the Force Majeure and applicable cancellation fees.

3d. Under all circumstances, you are free to cancel the trip subject to GG’s and each supplier’s terms and conditions. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

 

  1. TRAVEL INSURANCE & PAYMENT METHOD

 4a. For your protection, GG strongly recommends that you purchase trip cancellation insurance and that you check the appropriate box below. We also require that you use a credit or debit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
